Terms of Service

These Terms of Service ("Terms") govern your access to and use of RestaurantRadar (the "Service"). RestaurantRadar is operated by Marks Ventures, LLC, doing business as RestaurantRadar. In these Terms, "we," "us," "our," and "the Company" mean Marks Ventures, LLC. "You" means the person or business that accesses or subscribes to the Service. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

RestaurantRadar is a subscription information and alert service that notifies commercial service vendors of newly licensed restaurants in a chosen area. The alerts are derived from public City of Chicago business-license data. The Service is informational: it identifies potential sales opportunities, and it does not act as your agent, broker, or representative.

2. Subscriptions and Billing

Access to the Service is provided on a recurring subscription basis. Subscriptions renew automatically for successive periods until cancelled. You may cancel at any time; there is no long-term commitment or lock-in. Cancellation stops future renewals, and the Service remains available through the end of the then-current paid period. Fees are described at the time you subscribe.

3. Acceptable Use

You agree to use the Service only for your own lawful business purposes. You agree not to: (a) resell, redistribute, sublicense, or make the alerts or underlying data available to third parties as a standalone data product; (b) scrape, copy in bulk, or systematically extract the Service; (c) misrepresent your identity or use the Service to harass any person; or (d) use the Service in violation of any applicable law.

4. Your Outreach and Compliance

You are solely responsible for how you contact any business or person identified through the Service. This includes compliance with all applicable laws governing calls, texts, faxes, and email, such as the Telephone Consumer Protection Act (TCPA), federal and state Do-Not-Call rules, and the CAN-SPAM Act. The Company does not make outreach on your behalf and is not responsible for your communications.

5. Data Source and No Guarantee of Accuracy

Alerts are generated from public government records that we do not create or control. We do not guarantee that the data is complete, accurate, current, or free of error, and government sources may change, delay, or discontinue publication at any time. The Service is provided for informational purposes only and is not a substitute for your own due diligence.

6. No Guarantee of Results

We do not guarantee that any lead will be reachable, will need your services, or will result in a sale, contract, or revenue. Any business outcome depends on factors outside our control, including your own outreach and sales efforts.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or business, arising out of or relating to the Service. To the maximum extent permitted by law, the Company's total liability for any claim relating to the Service will not exceed the amount you paid to the Company for the Service in the three months preceding the event giving rise to the claim.

9. Modifications and Termination

We may modify, suspend, or discontinue the Service, or update these Terms, at any time. If we make material changes to these Terms, we will update the date above. Your continued use of the Service after changes take effect constitutes acceptance. We may suspend or terminate your access if you violate these Terms.

10. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in North Carolina have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
